Government Agrees to Mediate USERRA Matter Regarding Promotion Delay

FH+H Partner Kevin Byrnes and Associate Rachel Leahey recently drove the government to agree to mediate a Uniformed Services Employment and Reemployment Act (USERRA) matter pending before the Merit Systems Protection Board in which a former military reservist sought to secure back pay for a promotion delayed in error.

USERRA provides military reservists and active duty members with protections in their civilian employment. Mediation presents a potential road to resolution that can be lower cost and faster but still permits the claimant to achieve the results that led him to litigate in the first place.
